OPEN AIR PHOTO BOOTH RENTAL AGREEMENT 

TERMS OF AGREEMENT

The terms and conditions governing the agreement between Luminary Shots LLC., referred to as the "Provider," "We," or "Our," and the Purchasing Client, referred to as the "Client," "You," or "Your," effective as of the date of deposit payment. The purpose of this agreement is to provide high-quality photo booth rental services for your specified event on the date, time, and location indicated.

This contract constitutes the entire agreement between the Provider and the Client and supersedes any prior agreements or understandings, whether written or oral. It is acknowledged by both Parties that they have read and understand the terms and conditions set forth in this Contract. Any modifications or amendments to this Contract must be made in writing and signed by both Parties.

SERVICE PACKAGE & PRICING :

Thank you for choosing Luminary Shots LLC. for your Photo Booth rental. We are thrilled to provide you with the following services based on your online selection as part of your rental package:

BOOKING :

To secure your desired date and services, we require a minimum booking period of 3 hours, along with an online deposit payment and agreement to terms and conditions prior to deposit payment. Once we receive these, we will ensure that your booking is confirmed and reserved exclusively for you. Rest assured that our professional team is committed to providing you with an exceptional experience from start to finish.

PAYMENT :

To secure your desired date and services, we require a non-refundable deposit of $250. The remaining balance will be due 14 days before the event date. We offer flexible payment options for your convenience, including debit or credit card. Our payment process is quick, secure, and hassle-free, allowing you to focus on enjoying your event with peace of mind. If you have any questions or concerns regarding payments, our friendly team is always ready to assist you.

TRAVEL :

We are pleased to offer complimentary travel within 45 miles from 27577 zipcode to the event location. For any additional travel beyond 45 miles, we charge a nominal mileage fee of $1 per mile. It's important to note that this rate applies to the one-way trip only, ensuring transparency and clarity in our pricing. Rest assured that our team is committed to providing you with exceptional service and value for your investment. If you have any questions about our travel policy or need assistance with logistics, please don't hesitate to contact us. We're always happy to help!

MISCELLANEOUS FEES :

As part of our commitment to providing you with the highest quality service, we strive to be transparent and upfront about all costs associated with our services. Please note that any costs incurred for travel and delivery of our service, such as parking, valet, tolls, etc., are to be paid by the client.

We understand that logistics can be complicated, and our team is here to assist you with planning and coordination to ensure a seamless and stress-free experience. If you have any questions or concerns regarding travel and delivery costs, please don't hesitate to contact us. We're here to help and look forward to serving you!

CANCELLATION/ RESCHEDULING :

We understand that unforeseen circumstances can arise and may require changes to your event date. If you need to cancel or reschedule, we kindly request that you provide us with at least 14 days' notice to avoid being responsible for the full invoiced amount. We value our clients and strive to be flexible and accommodating whenever possible, so if something occurs that affects your date, please let us know immediately.

PHOTO BOOTH SET UP & REMOVAL :

We provide hassle-free delivery, setup, and removal of the photo booth at your event location. Please grant  us access to the venue at least 30 minutes before the scheduled start time to ensure a smooth setup. After the event, we require up to 30 minutes to dismantle the setup. It is your responsibility to ensure that we have easy access to the event space, so we can complete our work on time.

INTERNET ACCESS :

To ensure guests can enjoy our photo booth videos, a reliable internet connection with a minimum speed of 10Mbps is required at the venue. If internet is unavailable, we may still provide guests with access to videos, but if immediate delivery is not possible, videos will be processed and delivered within 7 days. The Client is responsible for delivering the media files to guests, and we are not liable for any loss of data or issues related to internet connectivity. It is your responsibility to ensure the venue has reliable internet access.

EQUIPMENT :

We provide top-quality photo booth equipment for your event, and all equipment, including cameras, frames, lighting, platforms, backdrop, and other equipment used for the setup, are the property of Luminary Shots LLC. and must remain on-site.

Equipment should not be moved, modified or tampered with without our permission. The Client is responsible for any damage to the equipment due to misuse or mishandling, which will result in additional charges.

PHOTO BOOTH OPERATIONS

Guest will operate the photo booth by simply taping the screen to take photo(s) and entering their phone to send photo(s) instantly. An attendant will not be available unless it was selected as an add-on.

Please note that we are not responsible for any injuries or damages caused by improper use of the photo booth equipment, and by using our photo booth, guests agree to follow all safety rules and regulations."

MEDIA DELIVERY :

Guest will receive their videos instantly via SMS, Airdrop, or Email. However, we are not liable for any actions taken by guests after accessing, sharing, or storing their videos.

An online gallery of all media created by the photo booth will be provided to the client within 7 days after the event if requested. The client is responsible for archiving and protecting the media content, and we are not accountable for the lifespan or future changes in digital technology.

INCLEMENT WEATHER :

We shall not be responsible for delays or damages due to circumstances beyond our control, such as weather, government regulation, strikes, and power outages. We'll make every effort to provide alternative options in such cases.

SERVICE AVAILABILITY :

Despite our best efforts, technology can be unpredictable, and we cannot guarantee that the photo booth  will remain fully operational throughout the event.

We strive to minimize any downtime and will resume normal operations as quickly as possible. However, we will not be liable for any consequential damages resulting from service interruptions. We recommend having a backup plan in case the photo booth is temporarily unavailable.

RELEASE :

1. We may use your photo booth media for promotional purposes unless you request otherwise in writing.  By agreeing to this clause, you consent to the use of your media content for promotional purposes.

2. By agreeing to our terms and conditions, you grant us permission to use any media produced by our photo booth for promotional purposes. You understand and agree that we may take and use such images as described and release Luminary Shots LLC. of any and all claims, including but not limited to claims for invasion of privacy, defamation, or any other sort, arising out of or related to the use of the images.

3. We may share the media content produced at your event with third-party vendors and partners for their promotional purposes. We will not sell or distribute your media content without your written consent

LIABILITY AND INDEMNIFICATION :

1. We are not liable for any damages arising from or related to this agreement or the services provided. This includes any loss of profits, revenue, or data. By using our photo booth and services, the Client acknowledges and releases Luminary Shots LLC. from any claims, liabilities, or damages.

2. In case of equipment malfunction or failure to operate, Luminary Shots LLC. will not be liable for any damages. The Client agrees to hold Luminary Shots LLC. and photo booth attendants harmless against any liability related to equipment failure or loss of data.

3. Our liability, and that of any photo booth attendants, is limited to the amount of fees paid by the Client for the services rendered. The Client acknowledges and agrees that this limitation of liability is fair and reasonable and is essential for Luminary Shots LLC. to provide the services at the agreed-upon price.

SETUP REQUIREMENTS :

1. Our photo booth requires a 10' x 10' floor space with an 8' minimum ceiling clearance and a reliable 110V, 10 amps, 3 prongs electrical outlet located at least 15 feet away. Please note that the client is responsible for any damage caused to our equipment and/or attendants due to improper power provision.

2. For outdoor events, a dry spot on a paved or grassy surface, protected from weather conditions, is required. We reserve the right to cancel the remaining service time in unsafe conditions. Please note that no refunds will be given under such circumstances.

3. We prioritize the safety of all attendees and equipment. Contact us, if you have any questions or concerns about the space and power requirements or the safety of the event space. We are here to help and look forward to providing you with exceptional service.

CLIENT RESPONSIBILITY :

Attendant safety is crucial. To ensure a safe and secure working environment, the Client must take necessary precautions to eliminate any potential hazards or risks to our attendants. If the attendant feels that the working environment is unsafe or poses a threat of violence, harassment, or attack, they have the right to immediately cease operations and take possession of all equipment. No refunds will be given in such circumstances.
